In brief

In new-build property, notary fees amount to around 2 to 3% of the price (compared with roughly 7,5 to 8,5 % in existing properties), as the tax deduction is much reduced there. On a purchase of €250,000 represents around 6 250 € instead of ~18 750 €, that is nearly 12 500 € saving.

Your benefits

Why is it cheaper in new build?

Reduced tax share

Reduced transfer duties

In off-plan purchases (VEFA), the tax portion, the heaviest of the costs, is greatly reduced, bringing the total down to around 2 to 3%.

A home that meets current standards

Performance and guarantees

You buy a home built to the latest energy standards, with builder’s warranties and no works to plan.

Reinvested savings

Thousands of useful euros

The gap with existing homes often amounts to several thousand euros, which you can redirect to your project.

Understand

What do 'notary fees' consist of?

Duties & taxes

The tax portion paid to the State and local authorities. It is the largest part, and the one that is reduced in new build.

Disbursements

Costs advanced by the notary to prepare your file (documents, formalities).

Notary's fees

The notary's remuneration, set by a national scale.

Saving

Indicative estimate: 2,5 % for new-build (range of 2 to 3 %) and 7,5 % for existing homes, the bottom of a 7,5 to 8,5 % range since the rise in transfer duties in April 2025. This increase does not apply to first-time buyers purchasing their main residence. The exact amount depends on the property and the notary.

Frequently asked questions

Everything you need to know about notary fees for new builds

What are the notary fees on a new-build property in 2026?
In new-build, notary fees represent around 2 to 3% of the purchase price, compared with around 7.5 to 8.5% in the existing stock (most departments have applied transfer duties of 5% since April 2025), because the tax element (transfer duties) is greatly reduced. This increase does not apply to first-time buyers purchasing their main residence. The exact amount depends on the property and the notary; the simulator gives an estimate.
Do first-time buyers pay the 2025 increase in transfer duties?
No. For deeds signed between 1 April 2025 and 31 March 2028, departments may raise their rate from 4,5 % to 5 % at most. This increase does not apply when the home is the buyer's first property and becomes their main residence, that is, if they have not owned their main residence during the two years before the purchase, with no income or financing condition (BOFiP, BOI-ENR-DMTOI-10-20, published 17 June 2026). For new builds, a VEFA sale remains at the reduced rate, whether the buyer is a first-time buyer or not.
Why are notary fees lower for new-build properties?
Because the tax element, the heaviest, is reduced on a sale off plan (VEFA). Notary fees follow a national scale; disbursements correspond to the costs actually advanced for your file.
Are notary fees on new builds negotiable?
Notary fees follow a national scale and are barely negotiable; the tax portion is fixed. It is mainly the choice of new (rather than existing) property that reduces the bill.
Can notary fees be included in the loan?
Yes, in many cases the bank includes them in the financing, depending on your deposit and profile: the bank makes the decision. A JL HOME adviser can help you take them into account in your purchase budget.
Can reduced notary fees and the PTZ be combined?
Yes: the reduced new-build purchase costs and the PTZ zero-rate loan are two separate benefits that can be combined, subject to your eligibility for the PTZ, which is checked case by case and never promised in advance.
When are notary fees paid on new-build property?
They are paid at signature of the notarised deed. Under VEFA, the price is paid in instalments according to progress, but deed costs are due at signature.
