Bail réel solidaire (BRS): buy your main residence at a discounted price

With the BRS, you buy the home but not the land, which remains with an Organisme de Foncier Solidaire (OFS). The purchase price is below market value, capped by BRS regulations, in exchange for a land fee (redevance foncière) and a regulated resale. JL HOME checks your eligibility with you.

In brief

The solidarity real estate lease (BRS) separates the land of the built : a OFS retains the land; you buy the home at a below-market price, capped by the BRS regulations, and pay a fee for the land. Reserved for the main residence, under income ceilings, with TVA at 5.5% and controlled resale. It is can be combined with the PTZ.

Why the BRS

Getting onto the property ladder when the market is expensive

Discounted price

You do not buy the land

The land remains owned by the Organisme de Foncier Solidaire (OFS). You buy only the building: the purchase price is below market value, capped by BRS regulations.

TVA at 5.5%

A reduced rate on housing

Under the BRS, purchase benefits, subject to conditions, from the reduced 5.5% TVA rate instead of 20%, which further lowers the cost of buying your main residence.

Secure & sustainable

A rechargeable long-term lease

The bail réel solidaire lease runs for 18 to 99 years and is reset at each resale. Access remains protected over time, with no works expected on a new home built to RE2020 standards.

Terms

The 4 conditions of the bail réel solidaire

1

Main residence

A home bought under BRS must be your main residence; it cannot be used for conventional buy-to-let investment.

2

Income ceilings

Your income must fall within income ceilings (close to social home ownership schemes), which depend on the zone and the composition of your household.

3

Price ceiling

The sale price per m² is capped by regulation and set by the OFS within that limit, which guarantees the affordability of the property.

4

Fee payable to the OFS

In addition to the price of the building, you pay a monthly fee to the OFS for use of the land. It is added to your loan repayments. An adviser will calculate it for your scheme.

⚠️ Regulated resale : the resale price is capped, and the buyer must also meet the income ceilings. The BRS is a scheme ofownership, not a speculative investment.

Comparison

BRS or full ownership: what changes

The BRS trades part of the potential capital gain for a much lower entry price.

Regulatory framework of the bail réel solidaire (separation of land and building via an OFS). The price, the fee and the ceilings depend on the programme and the area: an adviser confirms them for each home. No saving is quantified here.

The right combination

BRS + PTZ: two levers that can be combined

The discounted BRS price and the zero-rate loan can be combined for an eligible main residence: a lower entry cost on one side, interest-free financing on the other. Remember to include the BRS ground rent in your borrowing capacity. An adviser will do the full calculation with you.

Not to be confused with

BRS is reserved for the main residence

BRS (affordable home ownership)

To buy your main residence at a discounted price. Resale is regulated and the capital gain is capped: the logic is theownership, not speculation.

Buy-to-let investment (LMNP, LLI…)

For rent a property and earn income from it, under different rules (taxation, rents, tenants). See LMNP and LLI.

Why JL HOME

We check the ceilings, the fee and the PTZ combination

Eligibility for BRS depends on income ceilings, the programme and the OFS; the land levy weighs on your monthly budget. A JL HOME adviser will check these points, calculate the full monthly payment and the combination with PTZ, before any commitment.

Frequently asked questions

Everything you need to know about the bail réel solidaire (BRS)

What is the bail réel solidaire (BRS)?
The bail réel solidaire (BRS) is a home ownership scheme at an affordable price. It is based on separating land from buildings: an Organisme de Foncier Solidaire (OFS) remains the owner of the land, while you buy only the home (the structure). In return for occupying the land, you pay a monthly fee to the OFS. The result: a significantly reduced purchase price, for your main residence.
How does the separation of land and building work?
The OFS (office foncier solidaire) buys and keeps the land; you buy the building (the home) under a long-term 'bail réel solidaire' community land lease. As the land is not included in your purchase price, the price is below market and capped by BRS regulations. You own your home but rent the land, for a modest ground rent.
Who can buy under BRS?
Households wishing to buy their main residence whose income meets the applicable income ceilings (close to social home ownership). Eligibility depends on the zone, household composition and development. A JL HOME adviser checks these ceilings with you.
What price discount does the BRS allow?
Because you do not buy the land, you pay less than the market price, capped by the BRS regulations; the exact difference depends on the programme and the area. In return, the ground rent paid to the OFS must be factored into your monthly budget.
What is the fee paid to the OFS?
This is a ground lease: as the OFS remains the owner of the land, you pay it a monthly fee to occupy it. The fee is generally modest, but it is added to your loan repayments. Its amount depends on the programme and must be taken into account when calculating your borrowing capacity.
Can a home bought under a BRS be resold?
Yes, but resale is regulated to preserve the affordable nature of the home: the resale price is capped (indexed), and the buyer must also meet income ceilings and buy as their main residence, with approval from the OFS. The BRS is therefore not a speculative investment: it is a home-ownership scheme, not a buy-to-let investment.
Can the BRS be combined with the PTZ?
Yes: the zero-interest loan (PTZ) can finance the acquisition of the building under BRS, subject to meeting the PTZ conditions. It is a powerful lever for home ownership: a discounted price on one side, interest-free financing on the other. Combining the two is confirmed case by case with an adviser.
BRS or full ownership: what's the difference?
With full outright ownership, you buy the land and the home and resell freely at market price. Under BRS, you buy only the home (the land remains with the OFS), you pay a land lease fee (redevance foncière), and resale is capped at a limited price. BRS exchanges part of the potential capital gain for a much lower entry price, which helps access ownership when the market is expensive.
Are there tax advantages with the BRS?
A BRS home generally benefits from a 30 % reduction in property tax (taxe foncière), which the commune may raise to 100 % (or abolish) by resolution. Any transfer duties (droits de mutation) are checked programme by programme.
