Investing through an SCI taxed at IR in 2026: a good idea?
Published on June 18, 2026 · Rental investment
Investing with others, preparing a transfer of assets, structuring a property portfolio: the SCI under income tax appeals to many. But it is a demanding vehicle, to be handled with care. Here is what to understand in 2026 to judge whether it suits your project.
What is an SCI?
A société civile immobilière (property civil company) allows several people to hold and manage a property through shares. It is a flexible legal framework, particularly useful for buying as a family or organising succession.
SCI under IR vs SCI under IS
The choice of tax regime is central. Under IR (the default regime), the SCI is transparent: each partner is taxed on their share of rental income. Under IS, the company is taxed on its profits and may depreciate the property, but the tax on resale changes markedly. This choice is structuring and hard to reverse: it should be studied in advance with a professional.
The advantages of an SCI under IR
Three advantages often come up:
- Tax transparency, simple to understand for unfurnished letting.
- Land deficit, usable for unfurnished letting under the real regime.
- Easier transfer, through progressive gifting of shares.
Limits and points of attention
The SCI involves formalities (articles of association, general meetings, accounting) and collective decisions. It is not a magic optimisation tool: if poorly calibrated, it adds complexity without any real benefit.
SCI under income tax (IR) and furnished letting
Key point: habitual furnished letting is in principle incompatible with an SCI under income tax (IR), as it falls under BIC and can lead to a switch to corporation tax (IS). If your project targets furnished letting (type LMNP), an SCI under IR is generally not the right vehicle — this must be properly validated before any structure is set up.
SCI under IR and new-build schemes
For unfurnished letting, an SCI under IR may serve as a framework for holding certain investments in tight-market areas, such as the LLI or the private landlord status (Jean-Brun). The exact conditions must be checked with an adviser and a legal professional.
When to seek support
As soon as an SCI involves several partners, an inheritance or succession planning issue, or a choice between income tax (IR) and corporation tax (IS), the support of a notary or a chartered accountant is strongly recommended. Structuring errors are costly and often only show later.
So, a good idea in 2026?
The SCI under IR is an excellent tool for the right objectives: joint ownership, unfurnished letting, succession. It is unsuitable for ordinary furnished letting and unnecessarily heavy for a simple project. Have your situation analysed by a professional before creating the structure.
